DUI Threshold Remains Unchanged

DUI Threshold Remains Unchanged

Grape Post Article

As the legislative session concludes, the Washington Winegrowers Association remains resolute in its stance against the proposed reduction of the legal blood alcohol concentration (BAC) limit for driving from 0.08 to 0.05. This legislative push did not muster enough support to pass the Senate floor this session. However, the battle is far from over, as similar proposals are expected to resurface in future sessions.

Why Oppose the Reduction?

One of the primary concerns voiced by Winegrowers is the potential impact on businesses within the wine industry, including wineries, tasting rooms, and vineyard-based events. Lowering the BAC limit to 0.05 would introduce significant challenges for establishments where alcohol is served, particularly in rural areas where transportation options may be limited. Moreover, the liability exposure for alcohol servers could increase, leading to legal uncertainties and operational challenges for wineries across the state.

Additionally, Winegrowers emphasizes the importance of addressing the root causes of impaired driving through targeted interventions and comprehensive strategies. While promoting responsible alcohol consumption and enforcing existing traffic safety laws remain essential, the Washington Winegrowers Association asserts that lowering the BAC threshold alone may not effectively address the complex issue of drunk driving.
